The principle of freedom of contract prevails in Turkish Law. This is a universal principle of contract law rooted in Roman Law. It grants individuals the freedom to act as they wish in debt relationships by presenting their independent will, allowing them to determine the party, form, and content of the contract. Despite the existence of this principle, it is not possible to circumvent a mandatory provision of the law with any contractual clause.
Furthermore, the existence of a specific structure is essential when drafting a contract to ensure it protects and balances the interests involved. For contractual provisions to be meaningful and legally protect the parties, the contract must possess a systematic structure formed with a legal notion (hukuk nosyonu).
