IT Law is the branch of law that concerns the sharing of digital information. It encompasses Internet Law, which defines the legal framework for the use of the Internet. In this context, concepts such as privacy and freedom of expression are also relevant to IT Law.
IT Law should be examined by dividing it into two main categories: “Information Technology Law” and “Internet Law.” Information Technology Law regulates provisions related to the distribution of both digitized information and computer programs. It includes regulations on ensuring information security and electronic commerce. Internet Law, on the other hand, examines the legal issues that arise from the use of the Internet. Internet Law must interact with many other areas of law, as it is related to other legal fields such as Internet access and usage, security, freedom of expression, and adjudication.
In Turkey, the Law No. 5651 on the Regulation of Publications on the Internet and Combating Crimes Committed by Means of These Publications was published in the Official Gazette dated 23.05.2007 and numbered 26530, to regulate the principles and procedures for combating specific crimes committed in the Internet environment through content, hosting, and access providers. Furthermore, Articles 243 to 246 of the Turkish Penal Code No. 5237 regulate “Crimes in the Field of Information Technology” and the penal sanctions to be applied when these crimes are committed.
